Sam Altman and Elon Musk are about to go head-to-head in a trial that could fundamentally change the trajectory of the world’s most prominent AI company. Jury selection kicks off on April 27th, and Musk is pushing forward with his 2024 lawsuit accusing OpenAI of ditching its original mission to develop AI for the benefit of humanity, instead chasing profits.

Musk was a co-founder of OpenAI, and he claims that Altman and co-founder Greg Brockman tricked him into funding the company, only to pivot away from the nonprofit, open-source ethos they started with. He wants Altman and Brockman removed from leadership, and he wants OpenAI to stop operating as a public benefit corporation. If he wins, he’s asking for up to $150 billion in damages, which he says should go to OpenAI’s nonprofit arm.

OpenAI, predictably, sees this differently. In their view, the lawsuit is “a baseless and jealous bid to derail a competitor,” designed to boost Musk’s own ventures—SpaceX, xAI, and X—which launched Grok as a ChatGPT rival. They’re not wrong that Musk has a lot of skin in the game, but the core question remains: did OpenAI abandon its founding principles?

This trial is going to get messy. We’ve already seen Musk drop fraud claims against Altman and OpenAI right before the trial, which suggests some legal maneuvering or settlement discussions behind the scenes. But the core breach of contract and fiduciary duty claims are still on the table.

The courtroom drama will be fascinating, but the real stakes are about what OpenAI becomes. If Musk wins and forces a restructuring, it could set a precedent for how AI companies balance profit and public good. If he loses, it’s a green light for the current model—where nonprofits spin off for-profit entities and everyone pretends the mission is still intact.
